Terms of Service

Welcome to DreamInk. By accessing or using our platform at dreamed.ink, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use our services.
1. Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction to create a DreamInk account. DreamInk is designed for adults to create personalized and co-created books. If you create a child-centered book or submit information about a child, you represent that you are the parent, legal guardian, or otherwise have the permissions required to provide that information and use it for the book. Children should not create accounts or use the service directly.
2. Account Responsibilities
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@dreamed.ink if you believe your account has been compromised.
3. User Content and License
Your Content
When you upload a photograph, add personal details, or provide story source material, you retain ownership of that content. By uploading or entering it, you grant DreamInk a limited, non-exclusive, worldwide license, sublicensable only to service providers, to host, copy, process, transform, and display that content as needed to create, review, support, store, print, ship, and operate the book project you requested.
License Scope
- We will not use your private photos, family details, or finished personal book as public marketing material unless you provide separate written consent.
- You are responsible for making sure you have permission to include the people, photos, likenesses, private facts, and source material you add.
- We may share the minimum necessary project content with service providers used for AI generation, storage, payment, support, printing, and shipping as described in our Privacy Policy.
- This license ends when the related account or project data is deleted, except for records we must retain for active orders, payment, fulfillment, support, legal, or security reasons.
4. Generated Content and Intellectual Property
DreamInk uses artificial intelligence and production tooling to draft story plans, text, illustrations, layouts, and book previews based on your inputs. You are expected to review the book before checkout or print. Regarding the generated content:
- Your license: Upon purchase, you receive a personal, non-exclusive, non-transferable license to use the generated book for personal, non-commercial purposes (reading, gifting, displaying in your home).
- Restrictions: You may not reproduce, distribute, sell, or commercially exploit the generated book or its illustrations without prior written permission from DreamInk.
- DreamInk's rights: DreamInk retains rights to the AI-generated illustrations, story templates, and underlying narrative structures. The specific combination created for your book remains associated with your account.
5. Acceptable Use
You agree not to:
- Upload photos, likenesses, names, private facts, or source material unless you have the right to use them for the requested book
- Upload inappropriate, offensive, or illegal content
- Use DreamInk to impersonate someone, defame someone, or expose private facts without permission
- Use the platform for any unlawful purpose
- Attempt to reverse-engineer, scrape, or extract AI models, prompts, or proprietary systems
- Create accounts for children — only parents or legal guardians may create and operate accounts
- Circumvent or disable parental consent verification mechanisms
We reserve the right to suspend or terminate accounts that violate these terms.
6. Payments and Refunds
Payment Processing
All payments are processed securely by Stripe. By making a purchase, you agree to Stripe's terms of service. DreamInk does not store your credit card information.
eBook Purchases
Digital books and co-creation credits are generated on demand. Because each custom book uses production resources, purchases are generally non-refundable once generation has begun. If generation fails because of a technical error on our end, we will either regenerate the affected content, restore the affected credit, or issue a refund where appropriate.
Hardcover Orders
Hardcover books are printed and shipped by our print partner after you review the digital book, shipping details, quote, and print file. You are responsible for checking the selected content and shipping address before placing the order. After submission to print, changes or cancellation may not be possible. If the physical product arrives damaged, is lost in transit, is the wrong item, or is materially different from the locked digital proof because of a DreamInk or print-partner production error, contact support and we will review whether a reprint, correction, replacement, or refund is appropriate. We generally do not refund user-reviewed content issues, low-quality source material, incorrect shipping details supplied by the customer, carrier or customs delays, or ordinary screen-to-print color differences.
Parent Verification Charge
Where a temporary card transaction is used for parent verification or legally required verifiable parental consent, the current amount is $0.70 and is shown in the verification flow. DreamInk attempts to refund the transaction after successful verification. This is not a book purchase.
7. Limitation of Liability
To the maximum extent permitted by applicable law, DreamInk and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service.
Our total liability for any claim arising from or related to these Terms or our services shall not exceed the amount you paid to DreamInk in the twelve (12) months preceding the claim.
DreamInk provides AI-generated content on an "as is" basis. While we strive for high quality, we do not guarantee that every illustration will perfectly match your expectations or your child's exact appearance.
8. Indemnification
You agree to indemnify and hold harmless DreamInk from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your violation of these Terms, your use of the service, or your violation of any rights of a third party.
9. Dispute Resolution
Any dispute arising from these Terms or your use of DreamInk shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
- Arbitration shall be conducted on an individual basis. You waive any right to participate in a class action or class-wide arbitration.
- Small claims exception: Either party may bring a qualifying claim in small claims court instead of arbitration.
- Opt-out: You may opt out of this arbitration clause by sending written notice to hello@dreamed.ink within 30 days of creating your account.
10. Governing Law
These Terms are governed by applicable law, except where mandatory consumer protection rules require otherwise.
11. Changes to These Terms
We may modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on our website at least 30 days before the changes take effect. Your continued use of DreamInk after the effective date constitutes acceptance of the updated Terms.
12. Termination
You may close your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive (including intellectual property, limitation of liability, indemnification, and dispute resolution) will continue to apply.
